Privacy Policy for User Personal Information

Edulogika [full corporate entity name)   “Edulogika”, “we,” “our,” or “us”) values your privacy.  This Privacy Policy (“Policy”) describes how Edulogika collects, uses , discloses, and otherwise processes the personal information described in this Policy   This Policy provides information about the privacy practices applicable to our site, www.edulogika.com, (“Site”) as well as the data we maintain on behalf of teachers, administrators, schools districts, counties, and other education institutions (“Educational Organizations”).

Your use of our Services (defined below), and any dispute over privacy, is subject to this Notice and our Terms of Use, available at Terms of Use.

Scope

Except as otherwise noted below, this Policy applies to the online personal information processing activities including, but not limited to: 

  • visitors to our Site where this Policy is posted, including www.edulogika.com,  and any other sites, mobile application(s), as well as any other products and services provided by us that display or include a link to this Policy (collectively, the “Services”);

  • individuals who register for or participate in our demos, webinars, trainings, and other events;

  • customers, vendors, and partners, whether current, former, or prospective;

  • individuals who are subscribed to receive news, information, and marketing communications from us;

  • individuals who participate in surveys and research conducted or facilitated by us; and

  • individuals that communicate with us or otherwise engage with us related to our Services.

Edulogika acts in different ways when processing personal data. 

  • We may act as controllers of your personal information when you visit our Site or interact with us through other channels (for example, in-person events). 

  • We act as a processor when our customer Educational Organizations (who are controllers of their student and employee personal data) use our products and Services and collect and process personal information in connection with our products, and other business activities. Edulogika provides Educational Organizations tools to collect, organize and analyze data about students and education professionals in their schools, and county and/or district management organizations. Educational Organizations collect information about students, parents and guardians, teachers and other individuals which is stored and processed by Edulogika on behalf of the Educational Organization.

  •  In these situations, the Educational Organization rather than Edulogika decides how the information will be collected, processed and stored. Edulogika’ s privacy and data security practices regarding such information are governed by the agreement entered into between Edulogika and the Educational Organization and applicable law.   See Section 9 Educational Organization.

Data Ownership: Edulogika acknowledges that all personally identifiable information of students, teachers, administrators, and educational staff remains the sole property of our customers. Edulogika does not claim ownership over such data and acts solely as a data processor on behalf of its customers.

For information about the data your Educational Organization collects, and the use of such information and any permissible disclosures to third parties, please contact your Educational Organization directly.  This Policy does not cover companies that Edulogika does not own or control.

Personal Information Collected

As further described below, we collect personal information in three primary ways: directly from you when you voluntarily interact with our Site and Services—such as filling out forms, registering accounts, or communicating with us; automatically, through technologies like cookies, device identifiers, and analytics tools that track your usage and behavior; and from third parties, using external sources such as marketing platforms, data analytics providers, and social media integrations that share information based on your engagement with their services. 

Personal Information Collected Directly from You

The personal information we may collect from you depends on how you use our Services or otherwise interact or engage with us, but generally includes:

  • Contact Information
    When you contact us, including via email, phone, or webform, we collect certain personal information from you, such as your name, phone number, email address, company, and any other similar identifiers, as well as your message, and any other personal information that you otherwise submit to us.

  • Survey Responses
    When you fill out our surveys, we may collect your survey responses, including information regarding demographics, preferences, and your opinion about our products and Services. Participation in our surveys is voluntary.

    If you participate in our promotions, we may collect your name, email address, and other registration information related to such promotions.

  • Professional Contact Information and Details
    When you engage with us in your professional capacity, we may collect your name, position, business email address, your organization’s postal address, business phone number, and other professional information.

  • Communications, Interactions, and other Requests
    When you email, call, or otherwise communicate with us, we collect and maintain a record of your contact details, a history of our interactions with you, and information about your use of our products. When you sign up for our newsletter, we collect your email address and communication preferences. We also maintain records of communications and information that you may post on our social media channels, and information you provide to us related to any customer support request.

    If you register for or attend an event that we host or sponsor, we may collect personal information related to your registration for and participation in such event.

  • Account and Registration Information
    If you register for an account with us, we may collect your name, email, job title, username and password. We may also collect information that you make available through your account, such as your affiliated business, photographs and comments, and other information that you submit through your account.

  • Preferences
    We also may collect information about your preferences, such as communications preferences, preferences related to your use of our Services, a record of your purchases from us, and any other preferences you provide when interacting with us.

Personal Information Collected from Third Parties

We may collect personal information about you from third-party sources, such as joint marketing/promotional partners, social media platforms, or other third parties.

  • Lead and Prospect Information
    We may receive lead and prospect information, such as names, email addresses, and contact information from third parties about individuals who may be interested in engaging with us. We may also engage with third parties to enhance or update our customer information. For example, we may receive certain personal information from data analytics and marketing providers for marketing and advertising purposes, and for purposes of reaching new customers.

    If you post information about us or engage with us on third-party platforms, such as through your social media account, we may collect personal information about you from that third-party platform or account (e.g., your social media username and/or handle). We and our providers automatically collect and derive personal information related to your use of our Services and your interactions with us. Such information may include:

    We use cookies, log files, pixel tags, and other tracking technologies to automatically collect information when users access or use our Services. We may collect device IP addresses, general location information, domain name, pageviews, date and time stamps, browser type, device type, device ID, internet service provider, referring and exiting URLs, operating system, language, clickstream data, and similar device and usage information.     We also collect activity information related to your use of the Services, such as information about links clicked, searches, features used, items viewed, and time spent within the Services.

Generally, we collect, use, and otherwise process the personal information that we collect for the following purposes:

    To provide our products and to operate our Services, communicate with you about your use of our products and Services, respond to your inquiries, gather feedback, fulfill your requests, communicate with you, run our day-to-day operations, and for similar support purposes.

Disclosures of Personal Information

Generally, we disclose the personal information that we collect to provide our Services, respond to and fulfil your transactions or requests, as otherwise directed or consented to by you, and as follows:

  • Affiliates and Subsidiaries
    We may disclose the personal information we collect to our affiliates and subsidiaries who will use and disclose this personal information in accordance with the principles of this Policy.    ​​

    We may disclose the personal information that we collect to our service providers and others who perform functions on our behalf or provide us services. These companies and individuals may only use the data as permitted by our contracts with them.

  • Others as Permitted or Required by Applicable Law
    We may disclose personal information to other parties to the extent permitted or required by applicable law. This may include regulators, government entities, and law enforcement. It may also include certain disclosures that we are required to make.

  • Security and Protection of Rights
    We may disclose your personal information when we believe it is appropriate to do so to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Use or this Policy, or as evidence in litigation in which we are involved.

  • With Permission
    We may disclose personal information in ways not described above. If we do so, we will notify you, and if necessary, obtain your consent.

  • Planning and Managing Events

For event planning and management, including registration, attendance, connecting you with other event attendees, and contacting you about relevant events and Services.

If we, or our affiliates, are or may be acquired by, merged with, or invested in by another company, or if any of our assets, are, or may be, transferred to another comp[any, whether as part of a bankruptcy or insolvency proceeding or otherwise, we may transfer the information we have collected from you to the other company.  We may also share certain personal information as necessary prior to the completion of such a transaction or corporate transactions such as financings or restructuring, to lenders, auditors, and third-party advisors, including attorneys and consultants, as part of a due diligence or as necessary to plan for a transaction (collectively, “Business Transfers”).

Aggregate and De-Identified Information

We may use and disclose aggregate and other de-identified data related to our business and the Services for quality control, analytics, research, development, and other purposes. Where we use, disclose, or otherwise process de-identified data (data that is no longer reasonably linked or linkable to an identified or identifiable natural person, household, or personal or household device) we will maintain and use the information in deidentified form and not to attempt to reidentify the information, except in order to determine whether our deidentification processes are reasonable and adequate pursuant to applicable privacy laws.

Cookies and Other Tracking Mechanisms

and our providers use cookies, pixel tags, and other similar tracking technologies to automatically collect information about browsing activity, device type, and similar information within our Site and Services. This information, which may be considered personal information in some jurisdictions, is used, for example, to analyze and understand how you access, use, and interact with our Site and Services; to identify and resolve bugs and errors in our Site and Services; to assess, secure, protect, optimize, and improve the performance of our Site and Services; to personalize content on our Site; and for marketing, advertising, measurement and analytics purposes. We may also de-identify and/or aggregate such information to analyze trends, administer our Site and Services, and gather broad demographic information for aggregate uses, and for any other lawful purposes.   • Cookies
    Cookies are alphanumeric identifiers used for tracking purposes. Some cookies allow us to make it easier for you to navigate our Site and Services, while others are used to support the security and performance of the Site and Services or to allow us to track activity and usage data within and across our Site and Services.

  • Pixel Tags and Similar Technologies
    Pixel tags (sometime called web beacons or clear GIFs) are tiny graphics with a unique identifier, similar in function to cookies. We may use these tracking technologies to understand users’ activities, to help manage content and compile usage statistics, and in emails to let us know when they have been opened or forwarded so we can track response rates and gauge the effectiveness of our communications.

  • Local Storage Objects
    Local storage is a web storage mechanism that allows us to store data on a browser that persists even after the browser window is closed. Local storage may be used by our web servers to cache certain information in order enable faster loading of pages and content when you return to our Site.     We and ad networks we work with may use the information we collect about you within our Site and Services, and on other third-party websites and services, to help us and these third parties identify other devices that you use (e.g., a mobile phone, tablet, other computer, etc.) to interact or engage with us or our Site and Services.

  • Advertising Networks
    We work with ad networks, channel partners, mobile ad networks, analytics and measurement services, and others (“ad networks”) to personalize content, as well as to manage our advertising on third-party websites, mobile apps, and online services. We may share certain information with ad networks, and we may each use cookies, pixels tags, and other tools to collect usage and browsing information within our Services, as well as on third-party websites, apps, and services. This information may include IP address, location information, cookie and advertising IDs, and other identifiers, as well as browsing information. We do not display third party advertising on the Site or via the Services.​

Your Privacy Choices

You have certain choices regarding our processing of your personal information, and we make available several ways for you to manage your preferences and privacy choices, as described below:

  • Marketing Communications
    We may send periodic promotional and operational emails or other similar communications to you. You may change your preferences or unsubscribe by following the instructions provided to you in the communication. If you opt out of receiving promotional emails from us, we may still send you communications that you have requested to receive from us.

  • Cookie Settings
    You can set your browser to block certain cookies or notify you when a cookie is set; you can also delete cookies. The “Help” portion of the toolbar on most browsers will tell you how to prevent your device from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to delete cookies. Visitors to our Site who disable cookies will be able to browse the Site, but some features may not function. If you visit our Site from a different device or from a different browser on the same device, you will need to apply your cookie settings for that browser and/or device as well. Currently, our Services do not recognize web browser “Do-Not-Track” requests. You may, however, disable certain tracking as discussed below (e.g., by disabling cookies).

You can control how participating ad networks use the information that they collect about your visits to our Site and Services and those of third parties, in order to display more relevant targeted advertising to you. Retention and Deletion of Records Maintained by Us

For Site visitors, and other individuals not affiliated with an Educational Organization customer: We retain your personal information for as long as reasonably necessary to fulfill the purposes for which it was collected or as otherwise necessary to comply with our legal obligations, resolve disputes, maintain appropriate business records, and enforce our agreements. If you would like to delete your personal information we may store in connection with our Site, you can do that at any time by contacting us info@edulogika.com See also Section 6 Your Privacy Choices. We may retain and use your personal information to the extent necessary to comply with our legal obligations.

Educational Organization Service Accounts

Our data retention is governed by our agreement with your Educational Institution. Schools and districts control retention periods and can request deletion at any time. If you have any questions regarding the deletion of the information Educational Institutes shares with Edulogika, please contact your Educational Institution directly.

Children’s Information

Our Services are not designed for users under the age of 18. If we discover that a child has provided us with personal information, we will delete such information from our systems. If you are a parent or guardian and believe we have collected your child’s information in violation of applicable law, please contact us as set forth in Section 13 Contact Us.

Educational Organization Information

Edulogika and the Services it provides to Educational Organizations comply with applicable provisions of law, including the Family Educational Rights and Privacy Act (“FERPA”) and equivalent state laws.


Student, Teacher and Other School Employee Information
Your Educational Organization uses Edulogika’s Services to assist with the administration of school-related activities and streamline how the organization collects, organizes, accesses and reports your information for educational purposes. The uses are specific to each Educational Organization and are governed by the agreement between Edulogika and your Educational Organization.

The data your Educational Organization chooses to store and process on Edulogika’s systems may include the following information:

​

(1) students and their parents and guardians: Demographic information including name, email address, and date of birth. 

  • Student education records including your student’s grades, attendance and behavioral records


(2) teachers and administrators: 

  • System usernames and passwords, 

  • Name, email address

  • Credentials obtained and the granting institution.

  • Information about the individuals’ employment with the Educational Organization.​


​Your Educational Institution determines the information collected, maintained and processed using our Services. If you have any questions regarding the collection, storage and use of the information Educational Organization shares with Edulogika, please contact your Educational Institution directly.

Disclosure to Third Parties

The disclosure of personal information stored and processed on behalf of Educational Organizations (“Education Organization Personal Information”) is governed by the agreement between Edulogika and each Educational Organization.   


Except for the ways outlined in this Policy and toprovide services to your Educational Organization, we will not disclose the information described in this Section 9 to any third party unless we believe that such action is necessary to:

  • Respond to a subpoena or similar investigative demand, a court order, or other request from a law enforcement or government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law;

  • In our belief, appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of our company, our users, our employees, or others; to comply with applicable law or cooperate with law enforcement; or to enforce our terms and conditions or other agreements or policies.

  • In connection with a Business Transfer.

Below is the list of entities to which Edulogika discloses personal information, and the purpose for which it discloses the personal information  Our third-party providers that process Educational Organization Personal Information are obligated to keep the personal information confidential and for our specific purpose.  Such providers are required to maintain reasonable security practices, to use the information only for the purpose of helping us deliver the services to your Educational Organization, and to prevent disclosure of the information to unauthorized parties.

Whether collected directly from our Site or maintained and processed on behalf of your Educational Organization, protecting the privacy of your information is important to us.  We have implemented safeguards that are intended to protect the personal information we collect from loss, misuse, unauthorized access, disclosure, alteration, and destruction.  The specific measures Edulogika takes to secure your information are defined by our agreement with your Educational Organization. Our Website and Services may contain links to third-party websites. Any access to and use of such linked websites is not governed by this Notice, but instead is governed by the privacy notices of those third-party websites. We are not responsible for the information practices of such third-party websites.

Third-party links and features are provided solely within the marketing portion of the Website. The administrative portion of the Website does not contain third-party links, features, or offerings of any kind. 

Changes to this Privacy Notice

We may make changes to this Policy from time to time, so please be sure to check back periodically. We will post updates to the Policy on the Site.
